Employee Rights in Florida
Employees in Florida have legal rights in the workplace. For many employees these rights include legal protections from being discriminated against at work because of their race, religious beliefs, skin color, sex, national origin, age, disability, veteran status, marital status, or genetic information (including family medical history). In recent years federal law has also been interpreted to prohibit discrimination in the workplace based on sexual orientation and gender identity. These legal protections are intended to make the workplace in Florida a fair playing field by prohibiting discrimination in hiring decisions, pay, promotions, disciplinary actions, layoff selections and firing decisions. These same workplace laws also protect many employees in Florida from having to work in hostile or abusive work environments that may result from unwanted sexual remarks or advances, offensive racial or ethnic slurs, or harassment based on an employee’s religious beliefs. Employment laws also provide many employees in Florida with other rights including a right to reasonable workplace accommodations for religious beliefs or disabilities; the right to be paid for work performed at the appropriate wage rate, including overtime pay; and the right to complain about illegal actions by an employer without suffering retaliation.
